GENERAL TERMS AND CONDITIONS OF SALE
These General Terms and Conditions of Sale govern the sale of merchandise through the website dipierrobrandstore.it (the "Site").
The products purchased on the Site are sold directly by Di Pierro Giovanni di Lorenzo & C. s.n.c. (the "Seller" ore "we"), which has its registered office in Italy at via Berardi n. 12, Taranto; business register number, tax code and VAT number 01898300734.
1. Business Policy
The Seller offers products for sale on the Site; its e-commerce business services are available exclusively to its end users, i.e. the "Consumers" or "Customers".
""Consumer"" shall mean any individual who is acting for purposes which are outside his or her trade, business or profession. If you are not a Consumer, please do not buy any products on this Site.
The Seller reserves the right not to process orders received from users who are not "Consumers" and any other order which does not comply with the Site's business policy.
These General Terms and Conditions of Sale regulate the offer, transmission and acceptance of purchase orders relating to products on the Site between the users of dipierrobrandstore.it and the Seller.
The General Terms and Conditions of Sale do not regulate the supply of services or the sale of products performed by third parties that are on the Site through links, banners or other hypertext links. Under no circumstances shall the Seller be deemed liable for the supply of services provided by third parties or for the execution of e-commerce transactions between users of the Site and third parties.
2. Prices and Currency
All prices shown on the Site and related payments and invoices are in Euro.
In order to help Consumers evaluate prices in their local currency, the Site offers a currency converter tool.
The final price charged to the Customers' credit cards may change, based on currency fluctuations and bank fees.
The Seller invites Customers to contact their Bank and enquiry about conversion values and fees related to any transaction.
Payments are charged in Euro, at the exchange rate in force on the day the transaction takes place.
Prices may change from time to time. Customers should check the final price before submitting an order form.
To place an order for the purchase of one or more products on dipierrobrandstore.it, Customers must fill out the online order form and send it electronically to the Seller, following the relevant instructions.
In particular, once an item and its size is chosen, Customers will need to click on the ""Add to Cart"" button.
It is then possible to continue shopping, add more items to the cart or proceed to check-out.
An order shall be deemed submitted when the Seller receives an order form electronically and the order information has been verified as correct. The Seller will send Customers an automatic receipt e-mail, containing a summary of the information related to the order form.
The price for the purchase of products and the relevant costs for shipping and delivery, as indicated in the order form, will be charged to Credit Cards or Paypal at the time an order is processed, as the products are shipped immediately.
If the Customers choose a Bank Transfer as means of payment, shipping will take place only once the relevant amount of money has reached the Seller's banking account.
The order form will be filed in the Seller's database for the time required to process the order and, in any case, as provided by law.
After an order form has been submitted, the Seller will process the order.
The Seller may not process purchases when there are not sufficient guarantees of solvency, when orders are incomplete or incorrect, or when the products are no longer available.
In the above cases, the Seller shall inform Customers via e-mail that the contract has not been executed and that the purchase has not been carried out, specifying the reasons thereof.
If the products displayed on the Site are no longer available once an order form is received, the Seller shall inform the Customers of the unavailability of the ordered products as soon as possible, and not later than thirty (30) days from the day after the order has been received.
If the order form has been sent and the price has been paid for items that are no longer available, the Seller will immediatly refund the amount paid for those items and the order shall be considered cancelled.
On dipierrobrandstore.it, we offer luxury and top-quality products for sale. These products are purchased by the Seller directly from fashion houses, manufacturers and dealers, and they are carefully selected through a strict quality control.
The Seller does not sell second-hand products, flawed products or products of lower quality than the corresponding market standards.
The main characteristics of the products sold on dipierrobrandstore.it are detailed on each product page. However, the products offered for sale on the Site may not exactly correspond to the real garments in terms of image and colours, due to a different resolution on the Internet browser or the monitor that is actually used by the Customers.
All Products sold by the Seller come with an identification tag, which is attached with a disposable seal.
When trying on the products, Customers should not remove or alter the tag or seal from the purchased products.
As per the Italian Codice del Consumo, art. 57 II comma, once the items are received, Customers are responsible for any loss of value of the purchased products. Therefore, should a product be returned without the related tag and seal, or present damages as a result of the Customers' misuse, the Seller may refuse to accept a return and deny a full or partial refund.
Payment of the product prices and relevant costs for shipping and delivery must be made by using one of the procedures indicated on the order form. In any case, the fees charged by the Seller shall be higher than those actually paid, in relation to the chosen means of payment.
The Sellers accept the following means of payment:
PayPal is a secure payment platform with no fees.
At the time a transaction takes place, Customers are redirected to PayPal website, in order to complete their payments, which will be charged immediately.
For security reasons, the Seller only accepts payments coming from verified PayPal accounts.
The order will be processed upon receipt of the payment, given that the products are available at the Seller's warehouse.
5.2 Credit Cards
"In the case of payment by Credit Card, all details (for example, card number or expiration date) will be sent by encrypted protocol to Monte dei Paschi di Siena, without third parties having any access thereto whatsoever.
Such details will not be used by the Seller except for performing the procedure relevant to the Customers' purchase or issuing refunds in the case of returns, in compliance with the exercise of Consumers' return right, or for reporting cases of fraud to the police.
The Seller accepts payments made via the following networks: Visa, MasterCard, American Express, Maestro.
If the Customers' credit card has sufficient funds and all the information is correct, the transaction is approved immediately and the order is confirmed via e-mail.
The authorized amount is temporarily reserved on the Card's account and it gets processed on the following working day.
Customers may choose to pay directly to the Courier, at the time of delivery, using cash for any amount smaller than €999.99 or checks for any amount equal or bigger than €1,000.00.
5.4 Bank Transfer
When choosing to make a Bank Transfer, Customers receive an automatic e-mail containing the Seller's bank details and all the relevant information to perform the payment.
Within 48 hours after submitting an order form, Customers shall confirm their payments and send a copy of the transaction to the e-mail address email@example.com.
The Seller reserves the right to cancel any order, in case a payment is not confirmed within 48 hours, as per the instructions above.
Orders are processed and shipped once the relevant amount of money is received.
6. Shipping and Delivery of the Products
The Seller ships worldwide, excluding Russia and Brasil, using DHL as a third party courier.
As required by the international commerce law, any shipped merchandise shall be accompanied by an invoice where the total value of the purchase and the value of each single item are declared in the original currency.
Once the availability of the items at the Seller's warehouse and the bank transactions have been verified, Orders are processed within 48 hours from the reception of the order form. Orders are shipped from Monday to Friday, 9-17 hr, excluding Bank Holidays.
Shipping costs vary, based on the value of the order and the destination Country, as shown in the dedicated page.
The indication of the delivery times is purely indicative and the Seller can not be held liable for any delay caused by circumstances beyond its control such as, but not limited to, meteorological conditions and customs controls.
When assigning an order to the courier, Customers receive a notification e-mail from DHL, which provides the tracking number (AWB) for the order.
To monitor the shipping status of the shipment, you can visit the dhl.it site and enter the AWB number indicated in the e-mail in the "Track Your Shipment" area.
Customers may also find their assigned tracking number, by accessing the reserved area of the Site in the Orders section and clicking on an order.
Some delays can be experienced at time of season sales.
If, for any reason, a parcel is not picked-up from the Customer in due time, the shipping costs and any customs duties related to DHL automatic return will be deducted from the refund due to the Customer.
Upon receiving the goods, Customers are required to inspect the parcel carefully before signing the receipt.
Packages leave the Seller's warehouse always carefully sealed.
If a box has been opened by the Customs or by the Courier for any authorized inspection, it must be closed and sealed back with a control seal specifically placed by the Customs/Courier.
If the package appears not sealed or the original tape is not intact, the Customer is invited to sign the receipt of the package "with reservations" or to refuse the delivery.
In the event that there is evidence of the package being tampered, the Customer is required to open a complaint form with the local DHL office and contact the Seller immediately at firstname.lastname@example.org
Should a tampered parcel be accepted without reservations by the Customer, it will not be possible to pursue any further complaint.
By placing an order, Customers establish a commercial relationship with the Seller and agree to accept the delivery of the package for their order. If a parcel is not delivered to the Customer's address due to a Customer's mistake (i.e. incorrect or incomplete information, absent recipient) or if the Customer refuses the delivery of a sealed parcel, the parcel is returned to the sender and the delivery costs are charged to the Customer.
In accordance with consumer protection legislation (Italian Codice del Consumo, art. 52), you have the right to cancel your contract with the Seller in relation to products purchased from the Site, without any penalty and for any reason, by notifying the Seller in writing within fourteen (14) calendar days, beginning on the day you receive the products.
Customers should send a written request to the email address email@example.com, detailing the code of the articles they intend to return and what kind of action is reqested from the Seller.
Once a return request is received, the Seller shall send the Customer a written confirmation.
Any exchange to a different size is free of charge.
Customers can choose to receive a full refund of the price of the products but this will not include shipping and delivery costs.
Once a return is requested, Customers shall send the products within 5 days from the reception of the Seller's confirmation email.
The only fees charged to the Customers are those related to delivery costs, excluding the case of exchange to a different size of the same article.
All returned products shall be shipped to the following address: Di Pierro Lorenzo, Via Berardi 59, 74123, Taranto (TA), Italy. Customers are responsible for the cost of returning the products and liable for any decrease in the value of the returned products, caused by handling them.
In addition to the terms above, the Cancellation Right is exercised properly if the following conditions are fully respected:
Should any of the requirements detailed in this policy not be fulfilled, the Seller will not accept a return and the products will be shipped back to the Customers.
Should the Cancellation Right be exercised properly, and all the requirements be fulfilled, the Seller will proceed with a full refund of any money received, using the same method originally used to pay for the purchase, unless expressly agreed otherwise.
In particular, payment by credit cards: the refunded amount will be visible on the statement at least 30 days after the refund is processed. This timing may vary, based on different credit card network set-ups.
Payment by PayPal or Bank transfer: refunds will be credited to the Customer's account as soon as possible, and no longer than fourteen (14) days after the return was approved.
If the conditions required to exercise the Cancellation Right are not satisfied, the Seller will send Customers an email to communicate so and they will not receive a refund of the money.
However, Customers can decide to receive the products back, in the same conditions they had been returned, by sending a written request to firstname.lastname@example.org within 14 days.
Customers are liable for any decrease in the value of the returned products, caused by handling them.
The Seller might decide to still offer a refund and deduct between 10% and 90% of the amount to refund, by communicating such option to the Customers via e-mail. Customers can then decide whether or not accept such partial refund or request to receive the products back, in the same conditions they had been returned and at own shipping expenses, by sending a written request to email@example.com within 14 days after receiving the Sellers' e-mail.
As an alternative to receiving a refund on their Credit Card, PayPal account or Bank Account, Customers can choose to receive a credit voucher, equal to the value of the refund they are entitled to.
The Seller will send the Customer an e-mail containing the details related to such credit voucher.
The credit voucher can be used only once, within three (3) months from reception, for a purchase of equal or bigger value, and it cannot be summed to other credit vouchers.
9. Governing Law
These General Terms and Conditions of Sale are governed by the Italian law and in particular by the Italian legislative decree 6 September 2005 no. 206 on distance contracts and by Italian legislative decree 9 April 2003 no. 70 on certain aspects related to e-commerce.
Any dispute between the Seller and each end user (Customers) will be transferred to the Tribunal of Taranto.
13. Amendments and updates
The General Terms and Conditions of Sale may be amended from time to time due to new laws and regulations or other reasons. The new General Terms and Conditions of Sale shall be effective as of the date of publication on dipierrobrandstore.it.
